How can I identify if a vehicle is prohibited?

  • Check the RTA’s prohibited vehicle lists.
  • Ask the manufacturer or a dealer for vehicle specifications.
  • Check the Owner's Manual for vehicle specifications.
  • Review the Vehicle Standards Information Sheet VSI 06 for engine modification rules.

Who does the prohibited vehicle condition apply to?

  1. Provisional P1 licences issued on and after 11 July 2005 and subsequent P2 licences issued thereafter.
  2. Provisional P1 or P2 interstate or overseas transfers on and after 11 July 2005.
  3. A re-issued P1 or P2 licence due to a disqualification for a driving offence that was committed on and after 11 July 2005.

Do the prohibited vehicle conditions affect learner drivers?

No. As learners can only drive under supervision, the conditions will not apply. A learner can attempt the driving test in a prohibited vehicle but is restricted from driving prohibited vehicles once a provisional licence is issued. Provisional licence holders are not allowed to drive prohibited vehicles, even if supervised.

What is a modified vehicle (engine performance modification)?

Rules for the modification of engines are available in the Vehicle Standards Information Sheet VSI 06. Any vehicle with engine performance modifications requiring an engineer’s certification for registration purposes is banned under the prohibited vehicle scheme.

What if I am disqualified again while I have a one passenger condition?

A new 12 month passenger restriction will be applied from the next issued provisional licence.

I was disqualified before the scheme started. Will I have a vehicle or one passenger condition when I get my licence back after 11 July 2005?

No. The passenger and vehicle conditions will only apply to provisional drivers who are disqualified for a driving offence committed on or after 11 July 2005. However, the peer passenger restriction will apply if you are under 25 years.

What happens if I move interstate?

It will be up to the registration authority of that state to recognise the conditions.

If you return to NSW and are eligible for a provisional licence, any remaining unserved period of a previous one passenger condition will be added to your licence.

Does the peer passenger condition apply to all P1 holders?

No. The peer passenger condition only applies to P1 drivers who are under 25 years of age.
